The process is voluntary, confidential and aims to foster understanding and collaboration to provide fair outcomes for everyone involved. The requirement to Family Dispute Resolution under the Family Law Act
Under the Family Law Act, attending family dispute resolution is a requirement for parties prior to commencing proceedings in the Federal Circuit and Family Court of Australia for parenting disputes. This legal requirement emphasises the importance of attempting family dispute resolution as the first step in resolving family conflicts. It provides an opportunity to find resolutions outside the courtroom, prioritising open communication and understanding.

The Family Dispute Resolution / Mediation Process

Step 1: Check Availability and Book Mediation Date:
Our mediation process begins by finding a suitable date for your mediation session. We'll check our mediator's availability and work together to secure a date accommodating everyone involved. To confirm your booking, a booking fee will be required.
Step 2: Information and Agreement:
Before the mediation session, we'll kindly ask you to provide us with some additional information about the nature of the dispute and the specific issues you'd like to address. Additionally, we'll invite you to sign a mediation agreement, which sets the foundation for a respectful and effective mediation process.
Step 3: Pre-Mediation Conference:
As part of our process, we'll arrange individual conferences with each party and their respective lawyers, if applicable. These conferences, held in strict confidence, take place up to four weeks before the scheduled mediation session. During this time, we'll assess the suitability of mediation, explain the process in detail, and gain an understanding of each party's interests and goals. In some instances, we might assess the dispute as not appropriate for mediation. If this is the case, we will let you know.
Step 4: The Mediation / Family Dispute Resolution Conference:
When the mediation session arrives, we'll start with a joint meeting unless there are safety concerns or parties prefer separate sessions. Your mediator will create a welcoming, safe environment for open communication and dialogue. We may conduct private sessions throughout the mediation, involve lawyers if necessary, and continue joint sessions to explore options and find solutions that prioritise everyone's needs.
Step 5: Documentation:
If an agreement is reached during the mediation, we are able to assist in documenting and formalising it. We aim to ensure that the agreement accurately reflects the decisions made during the mediation process, allowing the parties to move forward with confidence.
